5 Men Found In Gay Orgy Sentenced To Jail And 6 Strokes Of The Cane

The Selangor Syariah High Court on Thursday, 7 November, sentenced five men to jail for attempting to engage in gay group sex

The sentence, which was meted out by Syariah judge Mohd Asri Mohd Tahir, also involved caning and fine, reported Harian Metro.

The offence took place in an apartment at Bandar Baru Bangi, Selangor on 9 November last year.

At the time of the offence, the five accused were about to begin having an orgy when the apartment was raided by the Selangor Islamic Religious Department (JAIS) officers.

One of the accused, a 42-year-old married man, received a more severe punishment

He was sentenced to seven months' jail, six strokes of the cane, and a RM4,900 fine.

"You are married, you have a wife... and you did this, you betrayed your family," New Straits Times quoted judge Mohd Asri as saying.

The four other accused, aged between 27 and 37, were sentenced to six months’ jail, six strokes of the cane, and a RM4,800 fine.

They were charged under Section 52 and Section 28 of the Syariah Criminal Enactment (Selangor) 1995, which is in relation to attempting to perform sex against the order of nature.

The judge said that the sentence was not enough to serve as a lesson to the accused and the society in general

"All the accused were found naked in an apartment on the second floor with seven other men, including three who were non-Muslims, apart from condoms and lubricants found at the location," judge Mohd Asri said.

"The facts indicated there was preparation to commit sex against the order of nature, and this was not an initial attempt."

The raid was conducted following a public tip-off, reported Harian Metro.

The court's sentence has since made headlines all around the world

A report by Reuters notes that Malaysia practices a dual-track legal system, where sodomy and same-sex acts are illegal under Islamic law.

It stated that convictions of homosexual sex are rare in Malaysia and referred to a case in 2018 where two women were caned for 'attempting lesbian sex' in Terengganu.
